Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOUR CHILD MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Who we are
This notice applies to Utah Applied Behavior Analysis, LLC, doing business as Frontier ABA (“Frontier ABA,” “we,” “us”), and to all staff, employees, and contractors who provide services on our behalf.
Our pledge regarding health information
Frontier ABA is committed to protecting the privacy of your child's protected health information (PHI). We are required by law to maintain the privacy of PHI, to give you this notice of our legal duties and privacy practices, to follow the terms of the notice currently in effect, and to notify affected individuals following a breach of unsecured PHI.
How we may use and disclose health information
For treatment. We may use and disclose PHI to provide, coordinate, and manage your child's care, including sharing information with the BCBAs, behavior technicians, and other providers and team members involved in that care, and with other health care providers involved in your child's treatment, such as your child's pediatrician or psychologist.
For payment. We may use and disclose PHI to obtain payment for services, including verifying insurance coverage and benefits, submitting claims to your health plan or Medicaid, and obtaining prior authorizations.
For health care operations. We may use and disclose PHI for quality assessment and improvement, staff training and supervision, licensing, audits, and other operations that support the care we provide.
Appointment reminders and communications. We may contact you by phone, mail, email, or text message to remind you of appointments and communicate about scheduling and account matters. You may request that we communicate with you by alternative means or at alternative locations, and you may opt out of text messages at any time by replying STOP.
Other uses and disclosures permitted or required by law
We may use or disclose PHI without your authorization when required by law; for public health activities; to report suspected abuse or neglect as required by law; for health oversight activities such as audits and inspections; in response to court orders or other lawful process; to avert a serious threat to health or safety; and for other purposes permitted or required by applicable law.
Uses and disclosures requiring your written authorization
The following uses and disclosures will be made only with your written authorization: (1) marketing purposes; (2) the sale of PHI; (3) most uses and disclosures of psychotherapy notes, where applicable; and (4) any other uses and disclosures not described in this notice. You may revoke an authorization at any time in writing, except to the extent we have already acted in reliance on it.
Your rights regarding your child's health information
You have the right to: inspect and request a copy of your child's PHI in our records, including an electronic copy where we maintain records electronically; request a correction (amendment) of PHI you believe is incorrect or incomplete; request an accounting of certain disclosures we have made; request restrictions on certain uses and disclosures of PHI; request that we restrict disclosure of PHI to your health plan if the disclosure is for payment or operations purposes and relates to a service you have paid for in full out of pocket, which we must honor; request confidential communications by alternative means or at alternative locations; and receive a paper copy of this notice at any time, even if you agreed to receive it electronically.
To exercise any of these rights, contact us using the information below. We may charge a reasonable, cost-based fee for copies as permitted by law.
Our responsibilities
We are required by law to maintain the privacy and security of your child's PHI; to provide this notice of our legal duties and privacy practices; to follow the terms of the notice currently in effect; and to notify you following a breach of unsecured PHI. We will not use or disclose your child's PHI other than as described in this notice unless you tell us in writing that we may.
Changes to this notice
We reserve the right to change this notice and to make the revised notice effective for PHI we already hold as well as PHI we receive in the future. The current notice will always be posted at frontier-aba.com/hipaa-notice and available in paper form on request, and will display its effective date at the top.
Complaints
If you believe your privacy rights have been violated, you may file a complaint with us using the contact information below. You may also file a complaint with the Secretary of the U.S. Department of Health and Human Services, Office for Civil Rights, at 200 Independence Avenue S.W., Washington, D.C. 20201, by calling 1-877-696-6775, or online at www.hhs.gov/ocr/privacy/hipaa/complaints. We will not retaliate against you for filing a complaint.
